If we look at the behaviors that our society has determined are criminal, we will discover that very few people actually break the law because they are aware of an effective alternative but choose not to take advantage of it. Our legal system most often punishes those who are most under-served by society. Society then continues the punishment after they have supposedly “served their debt to society” by spending time in prison by refusing to employ them. As a society, we like our victims and we tend to prefer them black or brown. We aren’t nearly as sophisticated as we like to pretend.
